GENERAL TERMS AND CONDITIONS
I. GENERAL
(1) These General Terms and Conditions ("T&Cs" or "Agreement") constitute and govern the contractual relationship between the parties, Lotteroo Group. hereinafter referred to as "Lotteroo" or "We", "Us"; or "Our"; and You, as the user and customer, hereinafter referred to as "User" or "You" or "Yours".
“Lotteroo” in these General Terms and Conditions refers to LTR Pay B.V. a company incorporated in Curacao, operating under the License No. 1668/JAZ, Authorized and Regulated by the Government of Curaçao.
"User" means any individual or entity that expressly or impliedly agrees to all these General Terms and Conditions by opening an account and placing bets on games with Lotteroo’s website www.lotteroo.com from time to time, hereinafter referred to as "Website".
Lotteroo and the User are the only parties to this Agreement.
(2) "Service" or "Services" shall include all services, casino offer activities related to the Services and listed on the Website including but not limited to casino games and other games of chance.
(3) All Users, accessing the Website agree to abide by these T&C's, Terms and Conditions for Bonus/Promotions and Privacy Policies, which collectively govern the use of the Services (the "Agreement").
The User must read, agree with and accept all of the General Terms and Conditions contained in this Agreement without modifications, which include those General Terms and Conditions expressly set forth below and those incorporated by reference, before the User may become an active, registered User of Lotteroo. By continuing to access or use the Website, the User agrees to follow the General Terms and Conditions of this Agreement. This Agreement shall also apply to all Services provided via mobile devices, including downloadable applications. All references to the use of the Website shall be construed as references to the use of our Services provided for mobile devices.
(4) Lotteroo may amend and/or assign this Agreement or any rights and/or obligations from time to time. The Terms and Conditions and the Privacy Policy are published on the Website and may be changed at any time. The new version of these Terms and Conditions will take effect immediately upon the next visit or login on the Website. By continuing to use the Website, the Services or the software offered by Lotteroo, the User agrees to be bound by the T&Cs as well as by the latest modifications to it. If the User does not agree to be bound by the changes to these T&C's, the User must not use or access Our Services, and inform Us in writing immediately. In order to avoid misunderstandings and disputes at a later stage, Users can print out these T&C's.
(5) This Agreement describes the terms, conditions and risks applicable to the User when using the Services available on the Website. For certain regions or devices Lotteroo might use other specific or country-specific domains in addition. If the User has any questions regarding this Agreement, please contact Customer Support.
(6) Lotteroo may publish these General Terms and Conditions in a number of languages and shall reflect the same principles. This is done for information purposes and to help players. It is however the English version that constitutes the legal basis of the relationship between You and Lotteroo. Should there be any discrepancy between the T&Cs in the English version and the version in any other language, the English version shall prevail.
(7) These General Terms and Conditions enter into force when you register and confirm Your registration details in the registration process on the Website. By registering an account with the Website You agree that you have read and understood these General Terms and Conditions. By using the Website you signify that you have accepted and agreed to the contents contained therein. You must read and understand these Terms and Conditions fully before registering an account with Us. Should You not agree with any part of this Agreement, You must not use or continue to use the Website.
(8) The services are available to, and may only be used by individuals, who can enter into legally binding contracts under the law applicable to their country of domicile.
Who can play
To play the games on the site you must be:
Over 18 years of age or above the legal age for gambling in the country you are playing from;
An actual person. You cannot be a company or other legal entity;
Playing the Games for yourself and in a non-professional capacity;
Legally allowed to play Games on the Site;
not resident in: Afghanistan, Algeria, Angola, Australia, Bahrain, Belgium, China, Cuba, Czech Republic, Denmark, Eritrea, Estonia, Ethiopia, France, Georgia, Greece, Guadeloupe, Guyane (French Guiana), Hungary, Hong Kong, Indonesia, Jordan, Iran, Iraq, Italy, Kuwait, Latvia, Libya, Lithuania, Malaysia, Martinique, Mauritania, Mauritius, Morocco, Norfolk Island, N. Korea, Oman, Pakistan, Portugal, Qatar, Rwanda, Saudi Arabia, Slovenia, Sudan, Somalia, South Sudan, Spain, Syria, Turkey, Tunisia, UAE, Yemen, United States and its dependencies, military bases and territories including but not limited to Am. Samoa, Guam, Marshall Islands, N. Mariana Islands, Puerto Rico, and Virgin Islands.
(9) In all circumstances Lotteroo shall not be held responsible for misuse of Our Services by any unauthorized parties or minors.
(10) Lotteroo reserves the right to refuse and/or cancel Services at its own discretion where the Services are illegal to use.
(11) The User guarantees at all times not to be a resident of countries including the United States and its dependencies, and territories including but not limited to American Samoa, Guam, Marshall Islands, North Mariana Islands, Puerto Rico, and the Virgin Islands, Cuba, Iran, China, Hong Kong, Macau, Sudan, North Korea, United Kingdom or Syria.
(12) Lotteroo is not liable for transmission errors. Therefore there shall be no claims for compensation due to any transmission errors, delays, or the misuse or manipulation of data.
In this context Lotteroo engages third parties for providing the Services. Lotteroo is also excluded from any liability regarding the Services.
(13) Lotteroo reserves the right to refuse a User registration, to impose certain conditions, to extend or change the Services, to reject wagers, bets in general and to limit bets, winnings or stakes any time without providing any reasons.
(14) Individual promotions and bonus may have additional Terms and Conditions, which are published separately. Please check carefully all Terms and Conditions associated with the individual promotions or bonus before taking part. Should the Terms and Conditions of the individual promotions or bonus conflict with or contribute to these General Terms and Conditions , these General Terms and Conditions shall apply, except where the General Terms and Conditions are explicitly excluded.
(15) Misconduct by Users is forbidden on the Website. A User's misconduct is deemed to be a violation of these General Terms and Conditions, whenever, but not exclusively, if the User:
a. Intentionally provides inaccurate or incomplete information;
b. Attempts to manipulate results through concerted practices, alterations of the software or Services or in any other undue way;
c. Deliberately cause malfunctions or defects of the Website in order to undermine the natural flow of the Services;
d. Sets up more than one account per person; and/or
e. Any other regulations set out in these General Terms and Conditions is violated.
This list above describing instances of misconduct is not exhaustive.
(16) Lotteroo reserves the right to terminate events or games without prior notice and at its own discretion, whenever it deems necessary, which are working incorrectly or malfunctioning.
(17) This Agreement shall be governed by and interpreted in accordance with the laws of Curacao, excluding that body of law pertaining to conflict of laws. Any legal action or proceeding arising under this Agreement will be brought exclusively in the courts of Curacao, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.
(18) In case that this Agreement is prohibited by the relevant legal authority, both parties are entitled to terminate this Agreement for cause. In such instances no further claims can be brought by either party.
(19) Lotteroo will not be liable in any way to any persons in the event of force majeure, or for the act of any government or legal authority.
II. REGISTRATION AND ACCOUNT
(1) In order to use the Website, the User must complete the registration form and open a User account ("Account") on the Website. The User must fill in the registration form provided by Lotteroo which shall at least include the following details:
a. The User's identity – The User warrants to, provide true, accurate, current and complete information regarding identity during the registration process. Any false information or impersonation of any person or entity, misrepresentation regarding any affiliation with another person, entity or association, use of false headers or other acts or omissions to conceal one's identity from Lotteroo for any purpose will be prosecuted under the fullest extent of the law. A User accessing Lotteroo Services may be asked to provide valid subsisting verification of identity and relevant information.
b. Date of Birth – The User assures Lotteroo that he/she is over 18 years of age. No person under 18 years of age or other higher minimum legal age in User's jurisdiction may be registered as a User and any funds deposited or any money won by any such person shall be forfeited.
c. The User's place of residence –Please note that the User may be asked to prove his/her place of residence by providing proof of identity such as copy of identity card, passport or driving license and/or utility bill;
d. The User's valid e-mail address and if available, contact number (phone / mobile)
e. Username – The username must be unique and clearly identifiable, personal and confidential. Offensive or indecent names are not allowed. Further prohibited are usernames that contain or allude to an Internet link or account names, which allude to certain rights of the User (ex. The term "administrator" is reserved for Lotteroo). We reserve the right to suspend accounts with an unacceptable username. Accounts can be reactivated as soon as suitable and an acceptable alternative username has been chosen.
f. Password - The User is advised to choose a strong and non-predictable password for security reasons and is responsible for ensuring that this password is kept as highly confidential. In the event that there is concern that the secrecy of Username and Password is no longer the case, the User should notify Lotteroo immediately.
(2) During and after the registration process the User may be required to provide Lotteroo with valid identification, including but not limited to the address, contact email and/or personal telephone number. In the event that Lotteroo has reason to believe that the information given is inaccurate, Lotteroo is entitled to suspend or terminate User's account and retain any winnings.
In Addition Lotteroo is entitled to require User to provide proof of age and to refuse a User's admission to the Service if it has reasons to believe that the minimum age requirement is not fulfilled.
(3) The User is responsible for securing the User's Username and Password for the account on the Website. Lotteroo holds no responsibility for any damage caused due to any act or omission of the User causing inappropriate or irregular use of the Account.
(4) The User shall ensure that the registration details are kept up-to-date and shall make any necessary changes of name, address or e-mail address on Lotteroo’s Website without undue delay. It is the User's responsibility to change his/her personal information if needed.
(5) Lotteroo is in no way responsible for any access to a User's account by a third person and will not be held responsible for any loss suffered due to the illicit use of a User's password by a third person, of unauthorized access, and/or for any transaction in which the name and password of a User was registered correctly.
(6) In order to place a bet with an account on Lotteroo’s Website, the User must have sufficient funds on his/her account for the bet he/she is going to place.
(7) With the use of an Account on Lotteroo's Website the User ensures at least the following:
a. The User has completed the registration form truthfully and correctly.
b. The User is not an individual under 18 years of age or other higher minimum legal age in User's jurisdiction.
c. The User is neither under legal supervision nor restricted in his business activities.
d. The User has registered personally on his/her behalf and not on the behalf of someone else.
e. The User uses the account for personal use and has no commercial intentions.
f. The User has no knowledge about any bet result of the underlying bet before placing it.
g. The User does not have multiple accounts on Lotteroo’s Website.
h. The User has read and accepts these General Terms and Conditions.
(8) Lotteroo accepts only one account per person. The use of more than one account per physical User is strictly forbidden. Lotteroo retains the right to close a User's account at any time and to cancel all the transactions pertaining to any User that has registered more than one account in his own name or under different names, in the event that Lotteroo has reasonable suspicion that the User has registered multiple accounts. It makes no difference whether the accounts have been used with the intent of defrauding or cheating, or otherwise.
(9) It is prohibited for Users to sell, pledge, transfer and/or acquire accounts to/from other Users. Funds can only be remitted to the same account from where they originated at the deposit stage.
(10) Lotteroo accepts only natural persons with a single account as a User. Neither a legal entity nor corporate body is allowed to open or to have an account on Lotteroo's Website.
(11) The User shall not treat Lotteroo as a financial institution nor expect interest on his/her deposit/s.
(12) The base currency is EURO (€), but the account balance of the User may be displayed in another currency.
(13) Any amount credited erroneously to a User's Account should be reported immediately to Lotteroo by the User. Any winnings and funds caused by an error are invalid regardless of how they occurred.
(14) In the event of misconduct by a User, Lotteroo is entitled to immediately terminate the Agreement with the User and exclude him from further use of the Website. Further, Lotteroo is entitled to interrupt and terminate on-going activities, to block the User or the User's Account with or without prior notice and to retain the User's credit and winnings achieved through misconduct until clarification of the situation.
(15) Any indication of fraud, manipulation, cash-back arbitrage, or other forms of deceitful or fraudulent activity which was the basis of a provision of a bonus or otherwise will render the Account inactive along with any and all profits or losses gathered.
(16) In countries where the report of winnings and losses is legally prescribed by legal authority or financial institution, the User is responsible for reporting his/her winnings and losses such authorities.
(17) Lotteroo will treat as highly confidential the information the User entrusts to it, in accordance with the disclosures it provides during the registration process and in accordance with its Privacy Policy.
(18) Lotteroo supervises all accounts and data in the strictest confidence. An obligation to disclose may be requested by the relevant authorities.
(19) Lotteroo reserves the right to refuse a User registration, to impose certain conditions, to extend or change the Services, to withdraw betting markets or other Services, to reject bets in general and to limit bets, winnings, odds or stakes at any time without providing any reasons and at its own discretion.
(20) There is no general right to registration, opening an Account or placing a bet on Lotteroo’s Website.
(21) If a User's registration has been refused or the Account has been closed at Lotteroo’s sole discretion, the contractual obligations already made will be honored.
(22) Lotteroo may waive a right or provision from these General Terms and Conditions in particular cases. Lotteroo will not be held liable and the User has no claim for a waiver of such right or provision in future matters.
(23) No person shall use the Website for the purpose of money laundering. Lotteroo may employ best-practice anti-money laundering procedures. Lotteroo reserves the right to refuse to do business with, to discontinue to do business with, and to reverse the transactions of Users, who do not accept or conform to the following anti-money laundering requirements and policies:
a. Winnings will only be paid to the individual who initially registered to open a live Account and specifically only to the originating credit card or account on file;
b. When a User funds an Account by means of credit/debit card deposits, winnings will only be distributed to the individual whose name appears on the card used to make the deposit and only be paid back to the same card. In the event of special circumstances, such as a change of card due to card expiry or a change of financial institution, the User may make a written request to Lotteroo's support and customer care, explaining the circumstance and providing the necessary documentation as to why winnings or withdrawals should be directed to another account or card. Lotteroo will process such request and when deemed necessary seek a regulatory ruling. Approval of such requests are the prerogative of Lotteroo;
c. Only one Account is allowed per person. No winnings may be collected on Accounts opened under false names or on multiple Accounts opened by the same person;
d. Transfer of funds between Lotteroo’s Account holders are not allowed;
e. Lotteroo may, from time to time, at its sole discretion, require a User to provide additional proof of identity such as notarized copy of passport or other means of identity verification as it deems fit under the circumstances and may at its sole discretion suspend an Account until such proof has been provided to its satisfaction;
f. All transactions are checked to prevent money laundering;
g. If the User does not respect these rules and regulations then Lotteroo may suspend the User's Account pending investigation.
(24) Any suspicious or fraudulent transactions will be immediately reported to the relevant authorities.
III. DEPOSITS AND PAYMENTS
(1) The player hereby agrees that LTR Group Limited, a sister company of LTR Pay B.V., incorporated in Malta with registration number C83468 and its registered address at Majestic Court 5, St. Mary’s Street, Mellieha, Malta, MLH 1337, is responsible for the Credit Card payment processing.
(2) All payments into the Account must be from a payment source on which the User is the named account holder.
(3) Several payment methods can be utilized in order to deposit funds to User's Account by transfer of money like credit cards, bank transfer and other electronic payment methods. Certain payment methods may involve charges depending on the volume of the transaction. Prior to effecting the payment, the User will be informed of the charges (if any). Visit the payments page on www.lotteroo.com to view the payment methods available and any associated fees. Bank transfers can take several days to be deposited on the User's Account. Cash Deposits are not possible.
(4) Lotteroo reserves the right to impose certain conditions on the use of particular payment methods. Lotteroo also has the right to change, add, limit or suspend the payment methods available without giving any notice. Lotteroo does not guarantee that all methods of payment are available at all times and for all countries.
(5) Lotteroo reserves the right to limit the minimum and maximum deposit amount per transaction for every provided payment method. The maximum deposit amount varies in accordance to the payment method used on the Website. Visit the payments page on on www.lotteroo.com for further information.
(6) The User acknowledges that Lotteroo reserves the right to request proof of transfer of deposits to User Accounts. High volume deposits may have to be approved by Lotteroo.
(7) The User acknowledges that any recall or similar actions of correctly transacted transfers via any payment method is not possible.
(8) Lotteroo reserves the right to request an image of both sides of the credit card used to deposit funds into the User Account at any time and at its own discretion. In order to reflect the best security practices, the User may be asked to black out the CVV number and certain card numbers.
(9) The User declares not to deposit money using a credit card, bank accounts and any other payment accounts and solutions to which he/she is not authorized.
(10) Lotteroo uses for all payment transactions secure connections to avoid unauthorized access by third parties in the best possible way.
(11) Self-deposit limits may be available through the use of the Website.
(12) Lotteroo reserves the right to recall any payment that is made in error.
(13) Users wishing to receive a payment (including withdrawals) via bank transfer (SEPA), and who reside outside the European Economic Area (EEA), will receive the requested payment/withdrawal amount less any applicable bank charges.
(14) Payments will only be effected in the Euro Currency.
IV. RESTRICTIONS
(1) Lotteroo wants to ensure that its Users gamble in a responsible manner, but We also acknowledge that gambling can be addictive to some and affect their lives negatively. Since We care for Our Users, and want online gaming to be an enjoyable experience, We offer various measures which can be taken by a User to gamble in a responsible manner.
(2) The Website contains links to external entities and information which can help in case of addictive gambling. If You believe that You might be addicted to gambling, We encourage You to seek help through these areas of Our website.
(3) By using the Services the User is acknowledging that placing bets on the Website is under the risk of losing money. It is the User's sole responsibility to assume the losses suffered through the User's Account;
V. WITHDRAWALS
(1) The User may request a withdrawal of the existing balance on his/her Account if at least the following is given:
a. All incoming payments have been confirmed.
b. All amounts deposited have been turned over at least once with online betting Services of Lotteroo.
c. The corresponding Bonus conditions are fulfilled.
d. The User's request and the withdrawal is in accordance to these General Terms and Conditions.
(2) Withdrawals from a User's Account can only be addressed strictly to the person registered on the Account in accordance to the conditions specified on the Website.
(3) Lotteroo reserves the right to transfer amounts via bank transfer, if the User's deposit method has no withdrawal option. In this case the holder of the bank account and the Lotteroo Account has to be the same person.
(4) Lotteroo's finance department handles all withdrawal requests submitted. Lotteroo reserves the right to verify the entitlement of the User and, in case of doubt, to retain the withdrawal. Valid documents issued by government and identity documents must be submitted in order to process a withdrawal. Lotteroo reserves the right to verify the User's identity, age and location at any time before processing any amount of requested withdrawal.
(5) The personal data of the User, of the account holder and the holder of the bank account (or any other payment method) must correspond. Lotteroo reserves the right to request further documentation for the proof of identity and verification of the bank account (or any other payment method) and retain winnings until such proof has been provided.
(6) Complaints regarding withdrawals must be submitted within 30 days of the withdrawal request.
(7) Once a withdrawal request is submitted it can take Lotteroo up to 3 business days to process the request. However, Lotteroo will be doing its best to process withdrawal requests immediately.
(8) Funds cannot be withdrawn from User's Account unless the same funds have been used for the Services at least once. A five percent (5%) administrative charge, with a minimum of five Euro (€ 5) per transaction may be applied for payout requests referring to amounts deposited with Lotteroo and which have not been used at least once for using the Services.
(9) Withdrawals of winnings or parts thereof will be paid out upon request of the User. The maximum withdrawal amount per transaction varies in accordance to the particular payment method used via the Website.
(10) Lotteroo reserves the right to reject withdrawals via a particular payment method and to transfer via bank transfer to User's bank account without providing any reason.
(11) Withdrawals can be deferred up to 30 days after User's request.
(12) The minimum withdrawal amount per bank transfer is € 25.00. Withdrawals with smaller amounts are only possible via different payment methods.
(13) Account holders playing on Lotteroo's Website can only withdraw funds through electronic payment methods and/or bank transfers, and/or through financial institutions. Lotteroo will not allow cash withdrawals.
(14) All transactions have to be processed in accordance with the European anti-money laundering regulations.
(15) Free games may be played by a registered and non registered Players. As long as the player is connected to the Internet and does not intend to bet real money, he or she can play the free online games offered on Our Website. Any winnings deriving from such free games are virtual winnings and are not redeemable into real money.
VI. ACCOUNT CLOSURE
(1) Users may choose to close their Account at any time. In such cases a User is requested to send an email to [email protected] and Our customer care will proceed with closing the Account and confirming to the User that such termination has taken place.
(2) Lotteroo reserves the right, in its sole discretion, to void any bets or winnings, to terminate the Agreement, to deactivate the Account, to refuse, cancel the Services, to block transactions from Account and/or refuse to distribute profits to anyone for any legitimate reason including, but not limited to:
a. The User provides incorrect or misleading information on his/her Account or upon registration.
b. The User has neglected or has failed to provide required identification documents.
c. The User provides documents which do not match with the data from credit card or other payment method account.
d. The User is not of legal age and not at least 18 years old.
e. The User has defrauded or attempted to defraud Lotteroo or any other party in any way. This includes any system based on the use of software, techniques, computer, machines or similar tool or the establishment of a syndicate of Users in order to defraud or to cause damage to Lotteroo, its Users or any other party.
f. The User has multiple Accounts registered on Lotteroo Website.
g. The User has allowed or permitted access to a third party to his/her Account. Lotteroo makes no exception for intentionally or unintentionally actions or reasons.
h. The User acts in an indecent way when communicating with Lotteroo's employees or other Users using inappropriate language via e-mail, chat or phone.
i. The User violates any terms of the Agreement and fails to comply with it.
This list of reasonable grounds above is not exhaustive.
(3) In the case where no transaction has been recorded on a User's Account for thirty (30) months, Lotteroo shall remit the balance in that Account to the User, or if the User cannot be satisfactorily located, to Lotteroo. From the twelfth (12th) month of inactivity, Lotteroo may charge a € 5 administration fee every month until the User logs back onto the Website, or until the 30 months lapse, but will not cause a negative balance on the User's Account.
(4) Lotteroo prohibits Users from using devices, such as robots, that distort normal use of the Services.
(5) The User expressly authorizes Lotteroo to collect any Account fees due and owing pursuant to these General Terms and Conditions by debiting the User credit card on file, or by debiting the User's Lotteroo Account.
(6) The term of the Agreement shall be for an indefinite period and should the User wish to terminate this Agreement at any time, he may do so by sending an e-mail notification to Lotteroo. As of termination, the User shall not be able to carry out new transactions.
VII. BETTING AND BET PLACEMENT
(1) Each User is obliged to read and acknowledge the General Terms and Conditions in their valid version, including all Casino and Slot Wagering Rules and provisions of minimum and maximum stakes, maximum payouts or similar provisions.
(2) Placing a bet or wager with Lotteroo, is only possible via the official Lotteroo platforms (e.g. Website or mobile version).
(3) Lotteroo is not liable for damages if the User can place bets or wagers despite insufficient credit. The bet has to be declared invalid. A completed bet or wager is only accepted if the User's Account has sufficient credit for such bet.
(4) Lotteroo reserves the right to reject individual bets or wagers, to limit the stakes on individual bets or wagers without providing a reason.
(5) Lotteroo reserves the right to cancel any bets or wagers up to the start of a live casino or tournament event, without giving any reasons.
(6) After the event has started, Lotteroo may cancel bets/wagers provided that the User is in violation of these General Terms and Conditions or betting rules as applicable from time to time, or, in particular, if she/he is under the suspicion of manipulation/rigging, of acting in collusion or forming a syndicate of Users, keeping duplicate gaming Accounts or using front men in order to place wagers.
(7) The recorded data of Lotteroo is relevant for all the contents of a bet. Obvious errors have to be reported by the Users. In the event that any information or result is incorrectly recorded, Lotteroo reserves the right to correct or declare results void and will take remedial action in order to rectify and amend the data in the system so as to reflect the correct information. Any winnings that are affected by the incorrect information will also be amended accordingly.
(8) Lotteroo determines a fixed time until wagers are accepted. The acceptance of a wager or bet will be confirmed and the accepted bet is listed in the User's Account in detail.
(9) For invalid bets or wagers the stakes will be refunded to the User's Account. This is in the particular case given when transmission errors occur, the date or time of the bet or necessary data of the User's Account are missing or incorrect.
(10) Only Lotteroo determines the deadline for accepting bets or wagers.
(11) Lotteroo reserves the right to correct or to declare results void, if the result has been caused by a technical default, by a manipulation of the particular event/tournament or by an error occurred at a payment transaction.
(12) Lotteroo assumes no liability for input, transmission and/or evaluation errors. Lotteroo reserves the right to correct obvious errors or declare the affected wagers as "invalid". Obvious errors may be typos, incorrect payables, or similar errors that affect the possible or actual winnings.
VIII. CONDITIONS SPECIFIC TO CUSTOMERS WISHING TO PLAY CASINO AND SLOT GAMES
(1) Lotteroo is licensed to provide the Casino Games pursuant to a licence granted to it by the Government of Curacao which is the regulator for all forms of gaming in Curacao, including games of chance.
(2) Location
a. All Casino Games take place in the territory of Curacao.
IX. Bonuses
(1) Separate Terms and Conditions
a. Lotteroo may, from time to time, offer promotions and/or competitions which are governed by separate terms and conditions. Any bonuses or special gifts credited to Your Account must be used in adherence with such terms and conditions.
b. Lotteroo's bonus terms, which comprise part of these terms and conditions, may be found under the relevant bonuses pages on our Website.
c. In the event and to the extent of a conflict between these Terms and Conditions and the promotion or competition specific terms and conditions, the promotion or competition specific terms and conditions shall prevail.
(2) Right to Rescind
a. Lotteroo reserves the right to withdraw any promotion, competition, bonus or special offer at any time. In addition, Lotteroo reserves the right to limit withdrawals from any Bonus Scheme.
(3) Jackpots
a. Lotteroo may from time to time, offer jackpot prizes on its casino and slots games. Each jackpot prize offer will be governed by separate terms and conditions, which are specific to the jackpot offer, and which comprise part of these terms and conditions.
b. Lotteroo's jackpot terms, which, may be found at the relevant jackpot pages, comprise part of these Terms and Conditions.
(4) Casino Bonuses
a. When using bonus money you have to complete the wagering requirements in order to make any cashouts of the bonus or winnings by bets using bonus money.
b. If not stated otherwise each offer is valid only during the date it was originally sent.
c. Unless anything else is stated for specific offers, the following wagering requirements applies:
• All Casino bonuses will have a wagering requirement of 35 times the sum of the received bonus and the deposit amount.
d. Table games do not contribute towards the wagering requirements.
e. Individual offers can have different terms, in this case such information shall be made available to the player.
f. Winnings from "free spin" or "bonus" rounds features initiated with bonus funds but completed after the bonus has been wagered, lost or forfeited will be removed.
g. The use of bonus funds purely to progress through the bonus stages of games can result in the winnings from the final bonus round(s) voided.
h. The use of bonus funds to win more than twice of bonus received on table games and video poker before changing back to slot machines with the purpose of completing wagering requirements can result in your winnings being confiscated and account being closed.
i. When playing with bonus money the maximum bet allowed is €10 (100 SEK, 100 NOK, £10, $10, 10 AUD, 10 CAD, 10 NZD) per spin or €1.00 (10 SEK, 10 NOK, £1.00, $1.00, 1.00 AUD, 1.00 CAD, 1.00 NZD) per bet line until wagering requirements have been met. This includes double up wagers and gamble features. Lotteroo reserves the right of voiding bets and winnings resulting from bets of larger amounts.
j. Where there is a reasonable suspicion that the account holder has committed or attempted to commit a bonus abuse, either on their own or as part of a group, Lotteroo reserves the right to:
• forfeit the bonus allocated to the account holder and any winnings from that bonus, and/or, revoke, deny, or withdraw a bonus offer from the Account Holder, and/or, block an access to particular products, and/or, exclude the Account Holder from any future promotional offers, and/or, terminate the Account Holder’s account with immediate effect.
X. CONDITIONS SPECIFIC TO CUSTOMERS WISHING TO PLAY LOTTERY GAMES
(1) Contractual Parties
When a Player participates in any Bookmaker's Game offered on the Website, the Player is accepting to enter into the agreement as described below:
a. When registering, and when placing an order for a bet on a Bookmaker's Game, the Player is entering into a contract with the Operator for the following services: the use of the Website; the operation and management of the Player Account; the placing of Bets and the payout of any Winnings to the Player.
b. The player hereby agrees that the Operator is placing bets on Bookmaker's Games on behalf of the player, with LTR Pay B.V.
All references in these Terms and Conditions in relation to a Player placing a Bet or in relation to the placement of Bets on Bookmaker's Games refer to, unless otherwise regulated, the placing of a Bet by the Operator with the Bookmaker for and on behalf of the Player in the jurisdiction where the Bookmaker is licensed and regulated.
(2) Definitions
"Bet" – a bet on the outcome of an event with a determinable outcome, for example the result of an underlying lottery offered by the Website
"Bookmaker" – means the company through which Bets are placed, being LTR Pay B.V.
"Bookmaker Game(s)" - Those games, based on underlying lotteries, made available to the Player through the Operator. For a list of available games and their format, please visit www.lotteroo.com/
"Jackpot" – the maximum possible winning at the Operator in respect to the underlying draw of the relevant Prize Category/Prize Categories of the relevant lotteries or the sum thereof.
"Operator" – Lotteroo.com.
"Prize Category" or "Prize Tier" – the category relates to the amount of numbers correctly matched (including Super Numbers, Stars, Euro Numbers, Powerballs, Megaballs and/or Bonus Balls as applicable) and which result determines the Prize Category in respect of the relevant draw of a certain Bookmaker's Game.
"Stake" – the sum of money the Player places on a bet in respect of a relevant game and for a certain Virtual Betting Ticket, including any service fees.
"Virtual Betting Ticket" – the electronic ticket displayed on the Website the compilation of which allows the Player to place bets on a Bookmaker's Game of his choice.
"Winning Bet" – a winning Bet, which was successfully submitted and placed by the Operator on behalf of the Player with the Bookmaker, including possible winning Bets introduced through a third party to the Operator and then placed by the Operator on behalf of the Player with Bookmaker.
(3) Placing of Bets
a. The Player effects an instruction to the Operator to place Bets with the Bookmaker on their behalf by filling out and submitting a Virtual Betting Ticket on the Website for their chosen Bookmaker Game/s.
b. Once any Bet has been submitted, it cannot be altered or cancelled by the Player.
c. The Player may review the full details of all bets placed by logging into their Player Account on the website and review Bet History or Active Bets as applicable.
d. Depending on the selected Bookmaker game/s, the Player may bet for a certain duration, that is place a bet for a certain number of consecutive draws, referred to as duration bets. Stakes for duration bets will be debited by pre-payment at the beginning of the relevant duration for all relevant draws for the selected duration.
e. The Player may, if this option is made available by the Operator, automatically extend Bets by selecting the "Subscription" option which is available separately for each Bookmaker Game. Depending on the selected Bookmaker game the player may then select a period for the automated placing of Bets for a period ranging from 1 to 52 weeks. After this Subscription period has elapsed the Bets are once again renewed automatically for the selected period of Subscription, unless a notice of cancellation is received via the Player Account. The cancellation of a Subscription must be received by 23:59h of the day prior to the day the period for automated placing of Bets ends. Stakes for following Subscription Bets will be debited by pre-payment for every following period of the Subscription.
(4) The Operator is authorised to, in its sole discretion, instruct the Bookmaker to void any Bets, whether Active or Settled if
a. the Operator was instructed to place a Bet after the relevant deadline or after the start of the relevant draw and/or if the Operator incorrectly accepted an instruction to place a Bet/s on the Website after the relevant deadline or after the start of the relevant draw
b. the Operator was instructed to place a Bet by a Player who has provided false information associated with their Player Account.
c. the Operator becomes aware of a genuine mistake in relation to a Bet or draw and is not able to contact the Player to correct the error or confirm the Bet prior to the deadline
d. the Operator was instructed to place a Bet by a Player who is involved in any fraud-related activities relating to the placing of the Bet, the operation of the Player Account or relating to the Website or the services offered by the Operator.
e. the Operator was instructed to place a Bet by a Player who was, at the time of placing the Bet, less than 18 years old,
f. the Player maintains more than one Player Account,
g. the draw is declared by an organiser or co-organiser as being invalid.
(5) Advertised Prizes
a. All of the advertised prizes by the relevant lotteries and by the Operator, are prizes gross of any relevant federal or state taxes/levies on winnings. Moreover, all advertised prizes by the relevant lotteries and by Operator, on those lotteries that pay out the advertised prize over a period of years, need to be discounted to the present value in order to account for a one time payment, instead of payments over a period of years.
(6) Winnings
a. Winnings on any Bookmaker's Game shall be credited to a Player Account and the Player is able to view any such Winnings on their Player Account on the Website. In addition, the Operator may decide, but is not obliged, to inform the Player with respect to Winnings by email, SMS/text message or other ways especially if there is a large win.
b. A Player with a Winning Bet will be treated equally by means that their Winnings will be the same as the pay out they would have received, had they bought a Winning Ticket in the underlying lottery. If the lottery operators have not announced a pay out in the first Prize Category for the relevant draw, the Winnings payable in respect of each Winning Bet in will be calculated by the Bookmaker on the basis of the estimation provided by the underlying lottery operator prior to the draw. If there is no winning bet on a Category 2 prize category or lower in the underlying drawing, the Player will be awarded the sum they had received, had they instead placed a bet on the most recent drawing which had a winner in the relevant prize category in the underlying lottery.
c. The Winnings payable in respect of each Winning Bet will depend on the number of Winning Tickets in the relevant Prize Category in the underlying lottery, the number of Winning Bets in the relevant Prize Category and the payable Prize by the operators in the underlying lotteries for the Winning Tickets in the relevant Prize Category. The Operator will calculate this amount on the basis of the amount of aggregate stakes published by the operators of the underlying lotteries as well as the distribution to the Prize Categories or on the basis of the amount published on the Website of the operators of the underlying lotteries for the Prize Categories of the relevant draw. The total of all Winnings payable by the Operator for the Prize Categories for a certain draw must never exceed the amount for the relevant draw and might be divided among the winners. Category 2 prizes are limited to Euro Two Million.
Example 1: There is one Operator Winning Bet in Prize Category 1 and no Winning Ticket has been announced by the operator of the underlying lottery in Prize Category 1 in respect of a Jackpot of 40,000,000.00 EUR. The Winnings payable in respect of that single Operator Winning Bet in Prize Category 1 would be 40,000,000.00 EUR.
Example 2: There is one Operator Winning Bet in Prize Category 1 and two Winning Tickets Bets have been announced by the operator of the underlying lottery in Prize Category 1 in respect of a Jackpot of 30,000,000.00 EUR. The Winnings payable in respect of that single Operator Winning Bet in Prize Category 1 would be 10,000,000.00 EUR.
Example 3: There are two Operator Winning Bets in Prize Category 1 and no Winning Ticket has been announced by the operator of the underlying lottery in Prize Category 1 in respect of a Jackpot of 40,000,000.00 EUR. The Winnings payable in respect of each Operator Winning Bet in Prize Category 1 would be 20,000,000.00 EUR.
d. Winning bets will be paid out as if the winner had participated in the underlying lottery. To this effect, applicable federal, state and city taxes will be applied to the advertised value in each relevant prize category. For lotteries organized in the USA, the net payout of a winning bet will be calculated as if the winner was a resident of New York City, USA. For lotteries organized in Spain, the net payout of a winning bet will be calculated as if the winner was a resident of Barcelona, Spain. For the pan-European lotteries EuroMillions and EuroJackpot, the net payout of a winning bet will be calculated as if the winner was a resident of Zürich, Switzerland and Barcelona, Spain respectively. For all other games, the net payout of a winning bet will be calculated as if the winner was a resident of the capital in the country where the underlying lottery is organized.
(7) Betting Rules
a. The Bookmaker will accept Bets placed by the Operator on behalf of the Player, where instructions to place the Bet/s have been placed on the Website by the Player and the Bet/s has been subsequently placed with it by the Operator.
b. Any reference in this section of the Terms and Conditions of a Player shall mean a Player placing a bet with the Operator.
For avoidance of any doubt the Bookmaker is not a lottery operator. With the Bookmaker, the Player is placing Bets on the expected results of the drawings of certain lotteries.
c. The Operator strives to ensure that all the jackpot values for all lotteries offered on the Website are correct, but assumes no responsibility for errors contained in such information. The Operator estimates the amount of future jackpots using certain assumptions, such as the current or future jackpot being won or rolled over, but is not liable for false assumptions, calculations or forecasts.
The Operator/Bookmaker reserves the right to offer and advertise prize higher or lower than the prizes advertised by the relevant underlying lotteries.
d. Valid Bets will be placed on the next relevant draw that takes place, provided that they are placed before the respective deadline and provided that the Player has not selected something else on purpose. The deadline will be displayed on the Website. It is up to the Player to make sure that the instructions are given to place the Bet before the relevant deadline. For the avoidance of doubt, instructions to place or the apparent placement of a Bet after the start of a specific draw or a draw that has actually occurred will not be valid, irrespective of any automatic confirmation, that may be generated via email or the Website, or irrespective of a wrong deadline displayed on the Website.
e. If an underlying lottery makes multiple draws on the same date, then unless otherwise specified by the Bookmaker, a Player's Bet will apply only to the main draw taking place on that date (or, where no main draw takes place, the first draw), under exclusion of any other draw made by the underlying lottery in question.
f. If a underlying lottery draw does not take place or no draw result is published or officially announced, all valid Bets on that draw will stand for the rescheduled draw (or, if there is none, the next available relevant draw).
g. The Operator shall pay out winnings as one lump sum As all Jackpots and second category prizes of the Operator are insured through the Bookmaker, such winnings may take up to 90 calendar days for clearance of payment by the insurance broker.
(8) System Games
a. If a player chooses a "System Game" Bet, all possible combinations of the selected Numbers are considered separate Bets.
(9) Syndicate Games
a. A syndicate is a group of individuals who choose to play the same number combinations together as a group. The Website refers to syndicate games as group games. All winnings from lines played by the syndicate will be shared between all the active members of the syndicate, depending on the amount of shares each individual has.
b. A share refers to the percentage of prize winnings a player is entitled to in syndicate play.
(10) Rights of the Operator
A Player cannot claim any Winnings or payout from the Operator and/or the Operator may at its discretion decide about the validity of a Bet or a Player's entitlement to Winnings or void a Bet if
a. Bets were placed after the relevant deadline or after the start of the relevant draw;
b. Bets were erroneously accepted after the relevant deadline or if the relevant draw had already begun or taken place;
c. The Operator becomes aware of an error in relation to that Bet or draw and is not able to contact the Player to correct the error or confirm the bet before the deadline;
d. the Bet was placed on behalf of a Player who has provided false information in connection with their Player Account or otherwise in connection with the Website or the services available through it;
e. the Bet was placed on behalf of a Player who has been involved in any fraud-related activities in relation to the placing of the bet, the operation of the Player Account or otherwise in connection with the Website or the services available through it;
f. the Bet was placed on behalf of a Player who was less than 18 years old,
g. the Player maintains more than one Player Account,
h. the draw is declared by an organiser or co-organiser as being invalid.
(11) When deciding if Winnings are to be paid out, the Operator may base its decision on information that is researched and/or held by Operator.
a. If any Bet is voided in accordance with Condition 7.1. (i), (ii), or (iii), the Operator will offer the Player, the option of placing any such Bet on the next relevant draw or crediting the Player's Player Account with the relevant sum. If any Bet is otherwise voided by the Operator in accordance with these terms, the relevant sum associated with that bet may be forfeited to the Operator, or except where the Bet was placed by a Player who is under the age of 18. In this case, the Operator will seek direction from the relevant Authority on how to account for the voided bet placed by an under-aged player.
b. The Operator decides about acceptance of a Player's Bet prior to the beginning of the draw. If the Operator does not accept a Bet, the Player will be reimbursed accordingly.
(12) Commitment to Decisions
a. In the event of a dispute in respect of a Bet or the payment or awarding of any Winnings, the Operator may withhold payment of the Winnings until any dispute has been fully concluded.
b. Where the Operator makes a final decision or exercises any discretion referred to above, the Operator may, solely at its discretion, reimburse the sum paid by the Player for the relevant Bet or offer a new Bet to the Player.
(13) Liability of Operator
a. The Operator shall not be liable for any loss or damage that may arise from the insolvency of third parties, including the Bookmaker or any bank, including (without limitation) any bank with which the Operator maintains its accounts.
b. Operator may, but Players may not, assign any rights and/or transfer, sub-contract or delegate any obligations under these Terms and Conditions, and/or charge or deal in any other manner with any contract created under these Terms and Conditions or any of Operator's or the Player's respective rights or obligations. For the avoidance of doubt, Operator may transfer and assign any contract between Operator and a Player to any third party (including an affiliated company of Operator) in conjunction with the transfer of all or part of the business and assets of Operator. In particular, Operator may transfer the liability of any payout to a third party by the use of various hedging arrangements, including but not limited to: Purchasing tickets in underlying lotteries, insurance contracts or catastrophe bonds. Depending on the hedging instrument chosen by the third party for any particular draw, Operator's liability towards the player is limited to the amount received by Operator from its hedging counterparts. Due to market conditions and the chosen hedging arrangement, Operator does not guarantee that the final winnings paid out to the player will equal the advertised amount.
c. The liability of the Operator against the Player is limited to the aggregate sum, which the Player has spend for a coming draw or Bet.
XI. MISCARRIED AND ABORTED GAMES
Lotteroo takes every precaution to avoid as much as possible, any technical anomaly or problem. However, this is not always possible. Consequently;
(1) Lotteroo, Our suppliers and / or licensors are not liable for any downtime, server disruptions, lagging, or any technical or political disturbance to game play. Refunds may be given solely at the discretion of the management;
(2) Lotteroo, Our suppliers and / or licensors accept no liability for any damages or losses which are deemed or alleged to have arisen out of or in connection with the Website or its content, including and without limitation to:
• Delays or interruptions in operation or transmission; • Loss or corruption of data; • Communication or lines failure; • Any site or content misuse; • Any errors or omissions in content;
(3) In the event of a system malfunction all wagers are void;
(4) If Your Game miscarries because of a failure of the system, We shall refund the amount wagered in Your Game by crediting it to Your Account or, if Your Account no longer exists, by paying it to You directly, in an approved manner. If You have accrued credit at the time the Game got miscarried, the monetary value of the credit will be paid out to Your Account or, if Your Account no longer exists, it will be sent to You directly, in an approved manner;
(5) Lotteroo shall take all reasonable steps to ensure that its computer system enables Your participation in a game. If after You have made a wager, game play is interrupted by a failure of the telecommunications system or a failure of Your computer system, the Game will resume as at the exact time immediately before the interruption occurred. If however, such resumption is not possible We shall:
• Ensure that the game is terminated; • Refund the amount of the wager to You by placing it in Your Account.
XII. PRIVACY POLICY
(1) By opening an Account with Lotteroo, the User implicitly gives his authorization to the processing of any personal data in compliance with the privacy laws in force in Malta for the use of the online betting services offered by Lotteroo. The supply of data to third parties is on an 'opt-in' basis.
(2) The User's data will be shared with Lotteroo employees for the purpose of their work.
(3) Lotteroo does its best to ensure the privacy, confidentiality and security of its Users.
(4) The Users undertake to supply Us with true, updated and accurate information about their identity. Furthermore, they are required to state categorically that they are registering on their own behalf and are not seeking at any time to act in any manner which could be considered fraudulent nor are they seeking to impersonate any other individuals for any purpose whatsoever.
(5) By registering with Lotteroo and through the voluntary interaction they undertake with Lotteroo's products and/or Services, the User confirms and agrees that they consent to the use of all or part of the information they supply concerning their Lotteroo User Account, the transactions they undertake through it and the interactions which they perform with Lotteroo and on behalf of Lotteroo. All interactions the User undertakes with Lotteroo will be stored by Lotteroo for the purposes of record and as such may be employed by Lotteroo in such cases where disputes arise between Users and Lotteroo.
(6) Lotteroo's data collection procedures include the collection of User's freely disclosed information as shared with Lotteroo, in addition to the placement of cookies for the purpose of gathering data about the manner in which Users interact with the Lotteroo's Website.
(7) Lotteroo utilizes Google Analytics, a web analysis service of Google Inc. ("Google"). Google Analytics uses so-called 'cookies", text files that are stored on Your computer and enable an analysis of Your use of the Website. The information generated by the cookies on the use of the Website (including your IP address) are transmitted and will be stored to a Google server. Google may use this information to evaluate Your use of the Website, to compile reports on the Website's activities for Lotteroo and provide additional services connected to the use of the Website and the Internet. It is possible that Google transmits this information to third parties if this is legally required or third parties process this data on behalf of Google. Google shall under no circumstances combine your IP address with other Google data. You can prevent the installation of cookies by setting Your browser software accordingly; however, We advise You that in this case You may not be able to fully use all functions of this Website. By using this Website You agree to all the data collected on You being processed by Google in the manner described above and for the above mentioned purpose.
(8) Lotteroo reserves the right to use additional services for evaluating the use of its Website.
(9) The access to data and the change of data are free of charge for Users. According to the Remote Gaming Regulations the full deletion of the data is not possible.
(10) Lotteroo will do its utmost to ensure the confidentiality of its Users' personal information including the implementation of data protection procedures designed to ensure User confidentiality. Lotteroo ensures that its data protection policy is regularly updated in order to ensure that the User's information is continually safeguarded.
(11) From time to time, Lotteroo may contact Users whether by phone or email for the purpose of offering them further information about Lotteroo. In addition, Lotteroo may, on occasion, seek to contact Users, whether by phone or email, for the purpose of informing them on unique promotional offerings provided by Lotteroo for its User. Users consent to receipt of such contact when they consent to our General Terms and Conditions when registering with Lotteroo. Any person wishing to opt out of further contact with Lotteroo must contact customer support.
(12) The User's data may be required by law or relevant authorities to be disclosed by Lotteroo. If Lotteroo may believe that disclosure is necessary, Lotteroo will disclose the information to the relevant public authorities.
(13) Any suspicious or fraudulent activities can be immediately reported to the relevant authorities.
XIII. COMPLAINTS
(1) In case of a complaint or an issue, the User is to contact customer support by email on [email protected] , detailing the nature of the complaint. Lotteroo customer care representatives shall reply to the User accordingly to address the issue, and will try to reply to all requests within 2 days.
XIV. SEVERABILITY CLAUSE
(1) Each clause contained in these General Terms and Conditions shall be separate and severable from each of the others. If any clause is found to be void, invalid, or unenforceable for any reason whatsoever, the remaining clauses shall remain in full force and effect.
